Please read carefully. By opening or using the HEARTBEAT OF ETERNIA app, including the light show, selfie camera, POWER QUEST, SKELE SMASH and any videos or other content (together, the "Experience"), you agree to these Terms. If you do not agree, do not use the Experience.
Your participation is entirely voluntary and at your own risk. You are solely responsible for your own safety, your conduct, your device and your surroundings at all times. Do not use the Experience while driving, cycling, crossing streets, on stairs or in crowds where you cannot see where you are going, or anywhere it is unsafe or not permitted.
The Experience uses bright, rapidly changing colors, flashing light effects, vibration and sound. A small number of people may experience seizures or other reactions when exposed to flashing light, even with no history of epilepsy. Do not use the Experience if you are sensitive to flashing light. Stop immediately and seek medical attention if you feel dizzy, disoriented, nauseous or unwell. Keep your volume at a safe level.
Artifact locations are approximate and are provided for entertainment only. They are not directions to any safe, open or authorized place. Always stay on public walkways, obey all laws, signage, venue rules and the instructions of venue staff, security and law enforcement, and never enter restricted, private, closed or hazardous areas. Do not trespass, climb, block entrances or roads, or put yourself or others at risk to find an artifact. GPS and map accuracy are not guaranteed.
Anyone under 18 may use the Experience only with the permission and supervision of a parent or legal guardian, who accepts these Terms on the minor's behalf and is responsible for the minor's use.
The Experience is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, availability or non-infringement. Features, rewards, unlock times and content may change, be delayed or be withdrawn at any time without notice. Rewards have no cash value and cannot be exchanged or transferred.
To the fullest extent permitted by law, you release and agree not to hold liable Wombat Fire, Billy Strings and his band, management, crew and representatives, the venue, promoters, ticketing partners, sponsors, licensors and each of their owners, affiliates, employees, contractors and agents (the "Released Parties") from any and all claims, losses, damages, injuries (including personal injury or death), property damage, device damage, data charges, battery drain, lost or stolen devices, or any other harm arising out of or related to your use of, or inability to use, the Experience. In no event will any Released Party be liable for any indirect, incidental, special, consequential or punitive damages. Where liability cannot be excluded by law, it is limited to the maximum extent permitted.
You agree to indemnify and hold harmless the Released Parties from any claim or demand, including reasonable legal fees, arising from your use of the Experience, your violation of these Terms, or your violation of any law or the rights of any third party.
Camera frames are analyzed on your device and are not uploaded or stored by the Experience. Your location is used on your device to show your position on the map and is not collected by us. Progress and scores are saved only in your browser. Photos you take are saved only where you choose to save or share them, and you are responsible for anything you share and for having permission from anyone who appears in your photos. To improve the Experience we collect anonymous usage statistics, such as which buttons and features are used. These are tied to a random ID, not to your name, and never include photos, camera footage or your location. They are processed by our analytics provider (PostHog). Maps and videos are provided by third-party services (such as OpenStreetMap and YouTube) under their own terms and privacy policies.
The Experience, its design, software, artwork, music and videos are owned by Wombat Fire, the artist and their licensors and are protected by copyright and trademark law. All rights reserved. You may not copy, record, reproduce, redistribute, modify or commercially exploit any part of the Experience or its content without written permission.
These Terms may be updated at any time. Continued use of the Experience means you accept the current Terms. If any part of these Terms is found unenforceable, the remaining parts stay in full effect.
